Hendershott sentenced to five years in prison for Aggravated Battery

DECATUR COUNTY, IN — A Greensburg man has been sentenced to five years in prison after pleading guilty to Aggravated Battery (Level 3 felony) and to Being a Habitual Offender because of prior felony convictions.

Kevin Hendershott was sentenced last week in Decatur Circuit Court by Judge Tim Day after prosecutors and defense attorneys entered into a plea agreement for a total of 16 years.

In addition to the five-year prison sentence, Hendershott will serve seven years on probation and four years on home detention.

The parties agreed that seven of those years would be probation, and three years were agreed to be home detention.

How the remaining six years would be served were to be decided by Judge Day.

The State, represented by Decatur County Prosecutor Nate Harter, argued for six years in prison based on Hendershott’s criminal history because of Hendershott’s prior criminal history and because he was already agreeing to home detention and probation.

“Mr. Hendershott already had secured a fair deal by reducing his total risk from 36 years to only 16 years,” Harter said. “I did not feel I could agree to a sentence that would release him straight to home detention and probation without having to go to prison first, given the nature of the offense and the length of his history of breaking the law.”

Court documents indicate Hendershott has prior felony convictions dating back 15 years, including Burglary (Class C Felony), two Possession of Methamphetamine convictions, Escape, Fraud, and Resisting Law Enforcement (all Level 6 felonies).

After both sides presented their arguments, Judge Day sentenced Hendershott to five of the six years in prison, with the sixth on home detention.
