GREENSBURG, Ind. – Charges have been filed against a Greensburg woman who was involved in a fatal 3-car crash in August that claimed the life of a Spiceland man.
Charity Rigby, 35, is being held without bond at the Decatur County Jail on suspicion of Operating a Vehicle While Intoxicated Causing Death, a Level 5 felony.
Deputies say they have received results from the Indiana State Department of Toxicology that indicate Rigby tested positive for an unprescribed anxiety medication at the time of the accident.
Court documents show Rigby was driving north on S.R. 3 near C.R. 650 N., when her vehicle crossed the centerline and struck two southbound vehicles around 5:40 a.m. on August 27.
The driver of the first southbound car, Cody Coy, 25, was rushed to Decatur County Memorial Hospital, where he pronounced dead.
The driver of the second vehicle was not injured, police said.
According to investigating officers, Rigby had her two sons in the vehicle at the time of the accident and she told police that she fell asleep at the wheel.
