Indianapolis, In. — The Indiana Supreme Court will hear a case involving a multi-million dollar judgment and a former tenant of Greensburg apartment complex next week.
Back in March of 2016 Genia Walmsley, 46, was accidentally shot with a nine-millimeter handgun while sitting on her couch in her Tree City Village apartment around 5:30 p.m. Police determined Matthew W. Joseph was cleaning a firearm when it discharged and went through a wall striking his neighbor. Walmsley was transported to Decatur County Memorial Hospital and later to an Indianapolis area hospital where she recovered.
Following the incident reports indicate Joseph apologized multiple times and sent flowers to the victim. He was criminally charged in the case.
In 2017 Walmsley was awarded a $6.8 million summary judgment against Tree City Village and New Generations Management. The court decision was reached after Landlords were served, but did respond to the complaint. The court later overturned the decision based on “excusable neglect.”
The landlords have now petitioned the Indiana Supreme Court to strike the decision by the Court of Appeals and reinstate the original jurisdiction over the appeal.
The case will be heard on September 24.
