(Decatur County, IN) – Decatur County Commissioners this week tabled approval of 2nd reading of the proposed biosolids ordinance.
Commissioners’ attorney Chad Smith presented the ordinance for 2nd reading, saying they’ve been editing it over the past few weeks and have included exemptions within allowable limits for the Westport and St. Paul utility plants and BEX Farms.
However, Evan Daily with Biocycle LCC asked to be exempt, saying his business is Indiana Department of Environmental Management-approved and follows the state agency’s guidelines.
He called the ordinance an overreach and believes it’s illegal for the county to create rules that are different from IDEM’s.
Daily threatened a lawsuit if he is not exempt.
Commissioners tabled the matter so they can further discuss it with legal counsel.
