Indianapolis, IN — A victory in court Tuesday for Governor Eric Holcomb means he can proceed with his lawsuit against Senate president pro tem Roderic Bray, House Speaker Todd Huston, and the Indiana General Assembly.
A judge in Marion County ruled that the governor can hire his own lawyers to sue the Indiana legislature over the state’s new emergency powers law and that Holcomb is not required to rely on the Attorney General in the case.
Indiana Attorney General Todd Rokita has sided with lawmakers in the dispute over emergency powers and the balance of power at the Statehouse.
The judge ruled that requiring the Governor to only use the Attorney General would basically give the state’s top lawyer more power than the Governor.
Rokita has filed an appeal.
