Brookville, In. — A Fayette County Superior Court Judge has ruled against a confined animal feeding operation near Brookville Lake. Thirteen landowners filed the lawsuit against the Franklin County Board of Zoning Appeals.
At least three members of the board had to vote in favor of the conditional use permit for the CAFO to continue operation. One of the “yes” vote came from Jeff Batcheler, the judge ruled that vote invalid because Batchler does not own property in Franklin County.
The Citizens Input Committee ruled previously that board members must also be Franklin County landowners.
The CAFO project was proposed by Scott and Susan Cooper from Liberty.
