Charges filed in accident that killed Rising Sun man

OHIO COUNTY, IN — A Vevay man has been charged in connection with a deadly wreck in Ohio County back in August.

According to Dearborn-Ohio County Prosecutor Lynn Deddens, Alexander Scott Lynn has been charged with Operating While Intoxicated Causing Death (Level 4 Felony), Operating While Intoxicated Causing Serious Bodily Injury (Level 5 Felony), and other related charges, which stem from the fatal collision on August 24.

Investigators say Lynn tried to pass an off-road vehicle occupied by two men on a double yellow line along Salem Ridge Road near Poorhouse Hill Road at the same time the vehicle was turning left.

The collision caused the UTV to roll over on the passenger side, trapping 34-year-old Brandon Foutty of Rising Sun.

He and the UTV driver, 63-year-old Leo Philpott of Vevay, were taken to St. Elizabeth Dearborn.

Foutty was killed while Philpott was seriously injured.

Lynn told investigators that at the time of the crash, he was on his way home from work in Northern Kentucky, and had smoked marijuana the day before while he was in Michigan.

According to court documents, one of the investigating officers said he smelled pot on Lynn.

The Indiana Department of Toxicology tested Lynn’s blood and it indicated a controlled substance in the form of THC in his system.

Lynn surrendered to local authorities and has had his initial court hearing.

“I am saddened by the loss of life and serious injury in this case,” said Deddens. “I commend the officers involved for their good work, and my office will vigorously pursue justice as we move forward with this case.”
